Fatal crash driver freed pending appeal

An HGV driver whose lorry crushed a Fife surgeon to death after skidding on ice and snow on the A1 in Berwickshire has been freed from prison pending an appeal.

Marc Bell, 38, of Gateshead, has served 53 days since being jailed.

He was found guilty of careless driving after his lorry struck the car of Dr Mahmoud Abdel-Fattah near Cockburnspath in January 2010, killing the 42 year old.

Until a recent change in the law, careless driving could not lead to prison, even when it led to a fatal accident. Bell will return to the Court of Criminal Appeal next month to hear whether his 12-month term should stand. As a result of his conviction, he was also banned from driving for two years - and that ban remains in force.
